Preamble
0.1 By using any applications in alpha-stage produced and/or published by LowPolyCube (in following called “LowPolyCube”/”LPC”/”owner”/”I”/”me”) and/or BugFighter Programming, you agree to the Terms & Conditions for aplha-testing of LPC-applications.
0.2 The person using these applications (in following called “user”/”you”/”he”), agrees to test the sofware and inform LowPolyCube if any problems etc. occur.
0.3 These alpha applications will in following be called “software”.
0.4 The tests which are performed by specific users or developers to verify that the software is fully functional and also to ensure that the software can be run and used without dangers will in following be called “tests”/”alpha-tests”.
1. Responsibility
1.1 LowPolyCube will not and cannot grant the completeness, validity, utility nor actuality for the information provided in the game.
1.2 You will use the applications provided at your own risk. Alpha versions of applications can be highly unstable. LowPolyCube will not be responsible for data loss or damage of any kind.
2. Ownership
2.1 The software is property of LowPolyCube (i.e. Dario Bloch). You may not redistribute, nor reuse any artwork, pictures, pieces of code etc. that are not specifically marked for reuse.
2.2 Exceptional cases are code snippets, that are distributed under Creative Commons Licenses (like CC0, CC3.0, …). I publish a list of all CC0 content and keep it up-to-date and complete to the best of my knowledge.
3. Confidentiality
3.1 The user agrees to promise complete secrecy about any matter concerning the software. He will not:
2) publish any screenshots/images/copies/etc. of any matter concerning the software; and
3) document the tests, with the exception of the necessary documentation to perform the tests; and
4) try to rebuild, decompile or disassemble the software.
It is only permitted to talk/write/etc. about the tests, if the colloquist is also part of the alpha tests and also agreed to this agreement. However, the user will have to make sure that no other individuals except of these alpha test participants receives any of the confidential information.
3.2 Every information that has not yet been published in any way by LowPolyCube is regarded confidential. The software is regarded published, as soon as it is updated to a public beta test or publicly released. Old versions and features of these versions that are not part of the publicly released software are still regarded confidential.
3.3 If you documented your tests, or while you perform the tests, you have to make sure that the security measures are capable of keeping any information classified.
4. Usage and Area of Application
4.1 By using the software and any other service of LowPolyCube, you agree to have read and accepted these Terms & Conditions and the regular “Terms & Conditions for software use” which can also be found under “General” in the main menu of the website “com.lowpolycube.de”.
4.2 LowPolyCube reserves the right to change these agreements at any time without giving reasons, even if those changes are not reasonable for the user, to complement present and future updates.
4.3 By downloading any alpha application by LowPolyCube through com.lowpolycube.de or any other platform, the user agrees to these terms and conditions.
5. Severability
If a clause of this Terms & Conditions is or becomes invalid, illegal or not enforceable in any jurisdiction, it shall not affect:
2)the validity or enforceability in other jurisdictions of that or any other provision of this Agreement
according to § 306 of the BGB of German Law.
6. Choice of Law
These Terms and condition are based on German Law. German Law will apply to the contractual relationship between user and LPC. Exception is the mandatory consumer protection regulations of the country, the user is regulary sojourned.
